Term and Conditions for VDS SwimClinics Ltd:

These Terms & Conditions apply to all services provided by VDS SwimClinics Ltd, including swim clinics, small group sessions and performance support. By booking or participating in any VDS Swim Clinics activity, you agree to be bound by these Terms & Conditions.

 1. Definitions

  • VDS Swim Clinics: The provider of swimming coaching and training sessions.

  • Participant: Any individual taking part in a swim clinic.

  • Parent/Guardian: A parent or legal guardian responsible for a participant under 18.

  • Session / Clinic: Any swimming session, camp, or programme organised by VDS Swim Clinics.

  • Website: The official VDS Swim Clinics website.

2. Eligibility & Participation

  • Participants must meet the minimum age and ability requirements stated for each clinic.

  • Parents/guardians confirm that the participant can safely take part in swimming activities.

  • We reserve the right to refuse participation if a swimmer does not meet the stated requirements.

3. Bookings & Payments

  • All bookings must be made via our website or approved booking method.

  • Full payment is required at the time of booking unless otherwise stated.

  • A booking is only confirmed once payment has been received.

  • Prices are listed in GBP (£) and include VAT where applicable.

4. Cancellations, Refunds & Late Payments

·       All bookings are binding once confirmed.

·       Cancellations made within 7 days of the clinic start date will be charged the full clinic fee, regardless of attendance, illness, injury, or any other reason.

·       Failure to attend all or part of a clinic does not entitle the participant to a refund, credit, or partial reimbursement.

·       Where payment has not yet been made in full, parents/guardians remain legally responsible for the full clinic fee if cancellation occurs within 7 days of the clinic start date.

Late Payments

·       Any outstanding balance not paid by the agreed due date will incur a late payment fee of 10% of the total clinic fee, unless otherwise agreed in writing by VDS Swim Clinics.

·       Late payment fees will be added to the outstanding balance.

·       Continued non-payment may result in the participant’s place being withdrawn and the matter pursued for recovery of fees.

·       Cancellations made more than 7 days before the clinic start date may be eligible for a refund or credit, at the discretion of VDS Swim Clinics.

·       If VDS Swim Clinics cancels a session or clinic, a full refund or alternative date will be offered.

5. Medical Information & Fitness

  • Parents/guardians must disclose all relevant medical conditions, allergies, injuries, or learning needs at the time of booking.

  • Participants must be medically fit to swim.

  • Failure to disclose medical information may result in removal from a session without refund.

  • We reserve the right to refuse participation if we believe attendance poses a health or safety risk.

6. Assumption of Risk

Participation in VDS Swim Clinics involves both water-based swimming activities and land-based training, including but not limited to dryland exercises, strength and conditioning, stretching, mobility work, and warm-ups.

Parents/guardians acknowledge that participation in these activities involves inherent risks, including but not limited to slips, falls, muscle strains, fatigue, impact injuries, and other physical injuries that may occur despite reasonable care and supervision.

By booking and allowing participation, parents/guardians voluntarily accept and assume all such risks on behalf of the participant and confirm that the participant is physically fit to take part in both swimming and land-based activities.

7. Liability & Indemnity

  • VDS Swim Clinics accepts no liability for injury, illness, loss, or damage except where caused by our negligence.

  • We are not responsible for incidents occurring outside scheduled session times.

  • Parents/guardians agree to indemnify VDS Swim Clinics against any claims arising from participation, to the extent permitted by law.

Nothing in these Terms limits liability for death or personal injury caused by negligence or any liability that cannot be excluded under UK law.

8. Supervision & Responsibility

  • Participants are supervised only during the scheduled session times.

  • Parents/guardians are responsible for prompt drop-off and collection.

  • Unless stated otherwise, parents/guardians must remain on site for younger participants.

9. Behaviour & Code of Conduct

  • All participants must follow coach instructions and behave respectfully.

  • Unsafe, disruptive, or inappropriate behaviour will not be tolerated.

  • VDS Swim Clinics reserves the right to remove a participant for behavioural reasons without refund.

10. Photography & Media

  • VDS Swim Clinics may take photographs or videos during sessions for promotional purposes.

  • By booking, parents/guardians consent to the use of such media on our website and social platforms.

  • If you do not consent, you must notify us in writing before the session.

11. Personal Belongings

  • Participants are responsible for their own belongings.

  • VDS Swim Clinics accepts no responsibility for lost, stolen, or damaged items.

12. Changes to Sessions

  • We reserve the right to change coaches, venues, session times, or content where necessary.

  • Reasonable notice will be given whenever possible.

13. Force Majeure

VDS Swim Clinics shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to extreme weather, facility closures, strikes, pandemics, government restrictions, or acts of God. In such circumstances, sessions may be rescheduled or credited at our discretion.

14. Illness Policy

Participants must not attend sessions if they are unwell or displaying symptoms of illness. VDS Swim Clinics reserves the right to refuse participation if a participant appears unfit to take part, without refund.

15. Right to Remove for Safety

VDS Swim Clinics reserves the right to refuse or remove a participant from any session if we believe continued participation poses a risk to the participant, other swimmers, or staff. Removal under this clause does not entitle the participant to a refund.

16.  Emergency Medical Treatment Consent

In the event of an emergency, parents/guardians authorise VDS Swim Clinics to seek appropriate medical treatment for the participant if they cannot be contacted immediately.

17. Data Protection & Privacy

  • Personal data is collected and processed in accordance with UK data protection laws.

18.  Website Use & Intellectual Property

  • All content on this website is the property of VDS Swim Clinics.

  • Content may not be copied, reproduced, or used without written permission.

19. Governing Law

These Terms & Conditions are governed by and interpreted in accordance with the laws of England and Wales.
